Terms and Conditions of Sale

1. Scope

These General Terms and Conditions of Sale (hereinafter: GTC) govern all orders placed on the TopVitality.ch website, operated by OSCIMED SA, located in La Chaux-de-Fonds (Switzerland).

2. Contract Language

In the event of a multilingual version, only the French text is authoritative. The other versions are provided for informational purposes only, and the seller shall not be held liable in the event of any discrepancies. All parties are advised to refer to the instruction manual included with the ordered product to ensure proper use.

3. Medical Devices – Regulations and Use

  1. As a Swiss manufacturer certified to ISO 13485, OSCIMED SA guarantees that the medical devices it markets comply with Swiss and European regulatory requirements.
  2. Customers agree to strictly follow the instructions for use (including the user manual). OSCIMED SA disclaims all liability in the event of improper use.
  3. Any misuse or improper use of the product will render the warranty null and void.

4. Ordering

  • The customer places an order via the online platform. All data provided is secured via an SSL certificate.
  • OSCIMED SA reserves the right to refuse or cancel any order in the event of a risk related to security, regulatory compliance, or if the product is out of stock.

5. Prices and Taxes

  • Prices are listed in Swiss francs (CHF). 
  • For Switzerland, they include VAT. For other countries, local taxes (VAT, import duties) are the customer’s responsibility and may be billed separately by the carrier.

6. Payment

  • Payment is made in advance by credit or debit card. The buyer must ensure that their 3D Secure banking system is activated in order to confirm payment.
  • Payments are processed through third-party providers: OSCIMED SA is not responsible for their specific terms and conditions.

7. Shipping

  • Shipped from Switzerland via Swiss Post or an express service.
  • Delivery times: Standard: approximately 5 business days for Switzerland; Express: 1 to 2 business days, excluding external delays.
  • If a specific delivery time is indicated in red on the product page, that time takes precedence and applies to the entire order.

8. Complaints and Returns

  • Money-Back Guarantee: You have 15 days after receiving your order to request a refund, in accordance with our return policy.
  • Warranties and Terms: In the event of a technical defect, our products are covered by a warranty in accordance with the applicable terms. Please refer to each product’s page for warranty duration and terms.

    9. Liability – Limitations

    OSCIMED SA cannot be held liable for:

    • the services provided by payment providers (credit cards, third-party services);
    • carriers (Swiss Post or others);
    • local distributors;
    • for the improper use of products contrary to the manufacturer’s instructions.

    10. Intellectual Property

    All content (text, images, trademarks, logos, instructions) is protected by copyright and intellectual property laws. Any reproduction or use without written authorization is prohibited.

    11. Protection of Personal Data

    Customer data is processed in accordance with the Privacy Policy. No data is shared with third parties without prior consent.

    12. Amendments to the Terms and Conditions

    OSCIMED SA reserves the right to amend these Terms and Conditions at any time. Amendments take effect as soon as they are posted online. The applicable Terms and Conditions are those in effect on the date of the order.

    13. Governing Law – Jurisdiction

    • These Terms and Conditions are governed by Swiss law.
    • Any dispute regarding the validity, interpretation, or enforcement of these Terms and Conditions shall be submitted to the competent courts of the Canton of Neuchâtel, Switzerland.
